The processing of Users' personal data takes place in accordance with the applicable legislation, with particular reference to Legislative Decree June 30, 2003, n. 196, containing the Personal Data Protection Code, as amended by Regulation (EU) no. 679 of April 27, 2016 - applicable from May 25, 2018 (hereinafter, jointly, the "Applicable Privacy Law").

Art. 13 of the Legislative Decree 30 June 2003, n. 196 containing provisions on "Protection of persons and other subjects regarding the processing of personal data", informs you:

Article 1
The data you provide (hereinafter the "Data") in the appropriate sections of the Site, using the object to be collected, registered, organized, stored, processed, modified, selected, extracted, compared, used, interconnected, blocked, communicated , dissemination, elimination and destruction ("processing"), in compliance with the law and confidentiality obligations.

Article 2
The Data will be processed for the purposes indicated below, also connected and instrumental to Bicipedia's activity, in particular: accounting, tax, commercial, marketing, promotional, statistics, sending of advertising and informative material, direct sales or placement of products or services.

Article 3
In relation to the relative indications, the Data Processing will take place through IT and / or telematic tools, or on paper, and in any case through suitable tools to guarantee security and confidentiality.

Article 4
The company responsible for data processing is Bicipedia, with registered office in via Einaudi 6 / B, 50065 Le Sieci - Pontassieve (Florence).

Article 5
The Data may be communicated, for the purposes of processing listed above, to natural or legal persons, entities or consortia, appointed by Bicipedia to provide processing, instrumental or support services to those of Bicipedia, in particular: companies that perform IT services, accounting, commercial, management, insurance, banking and financial, experts, consultants, lawyers, association bodies, public administrations, universities and research centers. They may also be communicated to subsidiaries and / or associated companies, even indirectly to Bicipedia.

Article 7
Users' personal data will not be transferred to countries not belonging to the European Union and which do not ensure data protection levels in line with the Applicable Privacy Law. Bicipedia also informs you that, in relation to the aforementioned Treatment, you can exercise the rights under art. 13 of the Law, including, in particular, the right to know your registered personal data, obtain its updating, correction or integration, oppose the processing of illegitimate data or carried out for commercial information purposes, sending advertising material , direct sales, interactive commercial communication. Article 8
It should also be noted that Bicipedia does not hold the authorization to process sensitive data (pursuant to art.22 of the Law) and therefore please do not enter in the appropriate boxes all those personal data suitable for revealing ethnic origin, religious, philosophical or other convictions, political opinions, membership of parties, trade unions, associations or organizations of a religious, philosophical, political or trade union nature, as well as suitable for revealing the state of health and sexual life.

Pursuant to the Applicable Privacy Law, starting from May 2018, Users will also have the right to exercise the following rights:

• the right to data portability or the right to receive your personal data in a structured format, commonly used and readable by an automatic device, and the possibility of being able to transmit them to another data controller freely and without impediments;
• the right to request the limitation of the processing of your personal data.

Rental Conditions

• The client (renter) is fully responsible for the rented equipment.
• The rented equipment is not insured. The renter takes 100% breakage risk and 100% theft risk.
• In case of theft or complete damage, the cost of the equipment will be charged on the renter at the wholesale price of the lessor, reconsidering the eventual current valuation due to the usury and to the time.
• In case of theft of the rented equipment, the renter must immediately report the theft to the local police authority.
• In case of damage of the rented equipment due to negligence or intentional damage or partial damage, the cost to repair will be charged on the renter.
• During the rental time it is possible to change the rented equipment with another of the same category. Against the payment of a fee, it is possible to have an upgrade in the equipment for a higher category. It is not possible to receive a refund in case of change with an equipment of lower category.
• The cost of the rented equipment is calculated with the last day of rental included, and it must be returned within 7 pm closing time of the date confirmed and fixed in the contract. 1 additional day of fee will be charged on the renter in case of return after that time.
• If the rented equipment is not returned, for any reasons, at the end of the confirmed rental time, the lessor will report theft to the local police authority after the 7th day from this date.
• The equipment can be returned before the end of the rental time, therefore there will be no refund for earlier returns. Refunds will be given only in case of sickness/accident showing a valid medical certificate.
• With his/her signature, the renter agrees to the appropriate adjustment of the seat height, brakes and bike geometry according to his/her personal data.
• With his/her signature, the renter declares that has received the rental equipment in perfect conditions.
• Online bookings can be canceled and refunds can be granted only according to the rules expressed on Booking Cancellation Conditions and Refund Policies page.
• These terms and conditions shall be governed and interpreted in accordance with the Italian law and submit to the exclusive jurisdiction of the courts of the country, even if the renter has his/her legal residence abroad.
• With the online booking this rental agreement is valid and legally binding.

In case of cancellation of a tour or bicycle rental by an user:

• cancellation is free of charge up to 15 days before the date set for touring / bikes rental.
• in case of cancellation of the date set for touring / bikes rental from 14 to 7 days before, an amount equal to 30% will be charged.
• in case of cancellation of the date set for touring / bikes rental from 7 to 1 days before, an amount equal to 50% will be charged.
• in case of non-participation in the touring or bikes rental 100% will be charged.

Booking cancellation and refund policies may be subject to change at any time.
